These Terms of Use ("Terms") govern your use of the ShiftPilot iOS application ("ShiftPilot", "the app"). ShiftPilot is provided by Vasile Piciriga, an independent app developer ("we", "us").
By downloading or using ShiftPilot you agree to these Terms. If you do not agree, do not use the app.
ShiftPilot is a personal planning and record-keeping tool for shift workers. It helps you plan shifts, track hours, and estimate pay.
ShiftPilot is not:
All earnings figures shown in the app are estimates. They depend entirely on the rates, supplements, and rules you enter, and on simplified calculation models. Actual pay is determined solely by your employer, your employment contract, applicable collective agreements, and applicable law. Always verify against your official payslip. Do not make financial, employment, tax, or legal decisions based only on ShiftPilot's figures; consult a qualified professional where it matters.
We grant you a personal, non-exclusive, non-transferable, revocable license to use ShiftPilot on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and Apple's standard Licensed Application End User License Agreement (EULA). Where these Terms are silent, Apple's standard EULA applies. These Terms supplement Apple's standard Licensed Application End User License Agreement, which applies to your download from the App Store.
You may not reverse engineer, decompile, or disassemble the app except to the extent permitted by applicable law, and you may not sublicense, sell, or redistribute it.
ShiftPilot requires no account. All data you enter is stored on your device, and — if you enable the optional Pro iCloud sync — in your personal iCloud account. You are responsible for your own data, including keeping backups (for example via device or iCloud backup). Because we never receive your data, we cannot recover it for you if it is lost.
Our handling of information is described in the ShiftPilot Privacy Policy (https://shiftpilot-legal.pages.dev/privacy), which forms part of these Terms.
ShiftPilot offers optional paid upgrades ("ShiftPilot Pro"): auto-renewable subscriptions (monthly and yearly, the yearly plan with a 7-day free trial) and a one-time Lifetime purchase. All purchases are made through Apple and are governed by the ShiftPilot Subscription Terms (https://shiftpilot-legal.pages.dev/subscriptions) and the App Store terms. Prices are shown in the app before purchase and may vary by country and over time.
You agree to use ShiftPilot only for lawful purposes and only to manage your own work information (or information you are otherwise entitled to record). You are responsible for the accuracy of the data you enter.
ShiftPilot, including its software, design, and content (excluding data you enter), is owned by us or our licensors and is protected by intellectual-property laws. These Terms grant you no ownership rights.
To the maximum extent permitted by applicable law, ShiftPilot is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be error-free or uninterrupted, or that calculations will match your actual pay.
Nothing in these Terms limits mandatory statutory rights that cannot be waived under the laws of your country of residence (including consumer-protection rights in the EU/EEA and UK).
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost earnings, arising out of or related to your use of ShiftPilot — including decisions made in reliance on the app's estimates. To the extent liability cannot be excluded, our total liability is limited to the amount you paid for the app in the twelve (12) months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intent, gross negligence, or injury to life, body, or health where such limits are prohibited.
You acknowledge that these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to the app. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You may stop using ShiftPilot at any time by deleting the app. We may terminate or suspend the license if you materially breach these Terms. Sections that by their nature should survive (including 1, 6, 7, 8, and 12) survive termination.
We may update these Terms from time to time. For material changes we will provide notice in the app before the change takes effect. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of your country of habitual residence, to the extent its mandatory consumer-protection rules apply, without prejudice to mandatory consumer-protection rules of your country of habitual residence. If you are a consumer in the EU: the European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
